By means of an agreement of wills – arbitration agreement – the parties submit the decision of the dispute to arbitrators chosen by them, if the dispute is not exclusively assigned to a court or the necessary arbitration, and is a right of patrimonial nature.
The arbitration agreement can be of two types. Arbitral Compromise, when the arbitration agreement has as its object a current litigation or Compromising Clause when it covers future litigation arising from any contractual or non-contractual legal relationship. The decision of the Arbitral Court has the same value as a court decision.
